Driver's License Revocation Periods for DUI - s. 322.271, F.S. and s. 322.28,F.S.

Driver's license suspension or revocation is a matter associated with a Florida DUI conviction or a failed DMV hearing. Following are the revocation periods for DUI convictions:

  • First DUI Conviction:
    • 180 day to 1 year license revocation
  • Second DUI Conviction:
    • Minimum revocation for 5 years
    • May be eligible for hardship license after 1 year
  • Third DUI Conviction (at any time):
    • Minimum 5 year license revocation
  • Third DUI Conviction (within 10 years):
    • Minimum 10 year license revocation
    • May be eligible for hardship license after 2 years
  • Fourth DUI Conviction (at any time) / Murder with Motor Vehicle:
    • Mandatory permanent driver's license revocation
    • No eligibility for hardship license at any time
  • DUI Manslaughter:
    • Mandatory permanent license revocation
    • No prior DUI convictions, may be eligible for hardship license after 5 years
  • Manslaughter / DUI Causing Serious Bodily Injury / Vehicular Homicide:
