MOLESTATION

Molestation is defined generally as the act of making unwanted and indecent advances to or on someone, especially for sexual gratification.  Florida Statute § 798.02 describes lewd and lascivious behavior very simply as “Any man and woman, not being married to each other, lewdly and lasciviously associate[ing] and cohabit[tating] together, or if any man or woman, married or unmarried, engages in open and gross lewdness and lascivious behavior, they shall be guilty of a misdemeanor of the second degree.” 

Molestation, or lewd and lascivious behavior includes, but is not limited to, flashing, streaking, sexual touching, unwanted sexual advances, rape, pornography, and exposure to sexually explicit materials.

Florida Statutes § 800.04, and 825.1025, respectively, create an enhancement for lewd and lascivious behavior that is perpetrated against or in the presence of a person under 16 years of age or an elderly person.
