Impoundment of Immobilization of Vehicle - s. 316.193 (6), F.S.

Vehicle impoundment is a possibility if you are arrested and are convicted of DUI in Florida. Vehicle impoundment or immobilization will not occur at the same time as imprisonment/incarceration.

  • First DUI Conviction:
    • 10 day vehicle impoundment
  • Second Conviction (within 5 years):
    • 30 day vehicle impoundment
  • Third Conviction (within 10 years):
    • 90 day vehicle impoundment

There are some exceptions to impoundment that may apply. Impoundment or seizure may not occur if the family of the driver convicted of drunk driving has no other means of transportation. The court may also dismiss vehicle impoundment if the vehicle owned by the defendant is operated by the employees of the defendant or his or her business.
