Probation - s. 316.193 (5)(6), F.S.

If convicted of DUI (driving under the influence) in Florida, you will likely face probation. Under section 316.193 (5)(6) of the Florida Statutes, a first conviction may result in a total period of probation and imprisonment not to exceed one year. For instance, you may be required to serve 10 days in jail and then may serve the remaining 355 days on probation.

While probation is certainly preferable to jail time, avoiding a conviction and therefore all penalties altogether is ideal. A skilled and aggressive DUI defense lawyer may be able to help you by representing you throughout the entire criminal court process and at your DMV hearing in order to help you avoid a conviction.
