Administrative Suspension Law - s. 322.2615, F.S., s. 316.193, F.S., s. 316.1932, F.S.

Administrative suspension of one's driver's license or driving privileges will occur after a DUI arrest, provided the driver fails to schedule a DMV hearing or is found guilty at his or her DMV hearing.

  • A first suspension for driving with an unlawful alcohol level (with a blood alcohol concentration of .08% or greater) will last for 6 months. A second or subsequent suspension will last 1 year.
  • A first suspension for a refusal to submit to a breath test, blood test or urine test will last for 1 year. A second or subsequent refusal will result in an 18 month suspension.

The suspension will be effective immediately. However, the arresting officer will issue a temporary permit which will be valid for 10 days from the arrest date.
